Terms of Service for FixKit

1. Acceptance of Terms

By downloading, installing, or using FixKit ("the App," "we," "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the App.

2. Description of Service

FixKit is a multi-tool utility application that provides various measurement and utility tools:

Free Tools (6 tools)

• Flashlight with brightness control
• Compass with Qibla direction
• Ruler for measurements
• Bubble Level for surface leveling
• Sound Meter for noise measurement
• Magnifier with zoom and image capture

Pro Tools (6 tools)

• Unit Converter for various unit conversions
• Protractor for angle measurements
• Network Info for WiFi and network details
• Battery & Temperature monitor
• Vibration Meter for device vibration detection
• Storage Analyzer for device storage information

3. License Grant

3.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device(s)
• Use the App for personal, non-commercial purposes
• Access both free and Pro features (if unlocked)

3.2 Restrictions

You may NOT:

• Copy, modify, distribute, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to derive source code
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the App for any illegal, unauthorized, or commercial purpose
• Sell, rent, lease, sublicense, or transfer the App to third parties
• Use the App in any way that could damage, disable, overburden, or impair the service
• Attempt to gain unauthorized access to any part of the App or its systems
• Use automated systems or software to extract data from the App

4. Pro Features and In-App Purchases

4.1 Pro Unlock Options

FixKit offers two ways to unlock Pro features:

1. Temporary 24-Hour Access

• Available by watching a rewarded video advertisement
• Grants access to all Pro tools for 24 hours
• Ads continue to display during this period
• Can be renewed after expiration

2. Permanent Lifetime Access

• Available through one-time in-app purchase
• Removes all advertisements permanently
• Grants unlimited access to all Pro tools
• Tied to your Google Play or Apple App Store account

4.2 Payment Terms

• All purchases are processed through Google Play Store (Android) or Apple App Store (iOS)
• Prices are displayed in your local currency and may vary by region
• Prices are subject to change without prior notice
• All sales are final and non-refundable except as required by applicable law or platform policies
• You are responsible for any applicable taxes, duties, or fees
• Payment information is handled exclusively by Google/Apple; we do not store payment details

4.3 Refund Policy

• Refund requests must be made through Google Play Store or Apple App Store
• We follow the refund policies of the respective app stores
• Refunds are granted at the sole discretion of Google/Apple
• Contact the app store directly for refund requests

4.4 Access and Features

• Temporary Pro access expires exactly 24 hours after activation
• Permanent Pro access is tied to your app store account and persists across device changes
• Pro features may be modified, updated, or discontinued at our discretion
• We reserve the right to add new Pro features or move existing features between free and Pro tiers

5. Advertising

5.1 Ad Display

The App displays advertisements through Google Mobile Ads (AdMob):

• Banner Ads: Displayed on the home screen (bottom of screen)
• Interstitial Ads: Full-screen ads shown at specific intervals
• Rewarded Video Ads: Optional ads that grant temporary Pro access

5.2 Ad Frequency and Policies

• No ads are shown on first app launch
• Interstitial ads are limited to maximum 3 per hour
• Interstitial ads appear every 3rd app open (after first launch)
• Interstitial ads appear every 3rd tool open
• Banner ads are hidden during camera-based tool usage for better user experience
• Ads are completely removed with permanent Pro purchase
• Temporary Pro unlock (24-hour) does NOT remove ads

5.3 Personalized Advertising

You may opt out of personalized advertising through device settings:

• Android: Settings > Google > Ads > Opt out of Ads Personalization
• iOS: Settings > Privacy > Advertising > Limit Ad Tracking

Opting out does not remove ads, only makes them less relevant.

6. User Conduct and Responsibilities

6.1 Acceptable Use

You agree to:

• Use the App in compliance with all applicable local, state, national, and international laws
• Use the App only for lawful and legitimate purposes
• Respect the intellectual property rights of FixKit and third parties
• Not use the App to harm, threaten, harass, or violate the rights of others
• Not attempt to gain unauthorized access to the App, its systems, or networks
• Not interfere with or disrupt the App's functionality or servers
• Not use the App to transmit viruses, malware, or harmful code

6.2 Prohibited Activities

You may NOT:

• Use the App for any professional, commercial, or critical applications
• Rely on measurement results for safety-critical decisions
• Use the App in environments where inaccurate measurements could cause harm
• Attempt to manipulate or bypass ad frequency limits
• Create multiple accounts to abuse free trial or promotional offers
• Use the App to violate any third-party rights

7. Permissions and Data

7.1 Required Permissions

The App requires certain device permissions to function properly:

• Camera: Required for Magnifier and Protractor tools
• Microphone: Required for Sound Meter tool to measure noise levels
• Location: Required for Compass tool to show accurate direction and Qibla
• Storage/Photos: Required to save snapshots from Magnifier tool
• Network Access: Required for ads, Network Info tool, and IP lookup
• Vibration: Used by Vibration Meter tool
• Sensors: Accelerometer and gyroscope for Level and Vibration Meter

7.2 Permission Management

• Permissions are requested only when you use the specific tool requiring them
• You may revoke permissions at any time through device settings
• Revoking permissions will disable the corresponding tools
• The App will not function properly without necessary permissions

7.3 Data Usage

• All sensor data is processed locally on your device
• No measurement data is transmitted to our servers
• See our Privacy Policy for complete details on data collection and usage
• Ad-related data is collected and processed by Google AdMob

8. Accuracy and Reliability

8.1 Measurement Accuracy

8.2 Tool-Specific Limitations

• Ruler: Accuracy depends on screen size calibration
• Level: Affected by device sensor calibration and surface conditions
• Compass: Requires device calibration and may be affected by magnetic interference
• Sound Meter: Provides approximate decibel readings, not professional-grade measurements
• Protractor: Accuracy depends on camera quality and lighting conditions
• Network Info: Information may be incomplete or unavailable depending on device and network
• Battery: Temperature and health readings may not be available on all devices

8.3 General Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will be error-free, uninterrupted, or secure
• Defects or bugs will be corrected
• The App is free of viruses, malware, or other harmful components
• Results will be accurate, reliable, or suitable for any particular purpose
• The App will meet your specific requirements or expectations
• Any stored data will not be lost or corrupted

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

9.1 Exclusion of Damages

WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage arising from App use
• Damages resulting from inaccurate measurements or tool malfunctions
• Interruption of service or loss of access to the App
• Any damages arising from third-party services (ads, app stores)

9.2 Liability Cap

• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
• For free users, our liability is limited to $10 USD or the minimum amount permitted by law

9.3 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability is limited to the maximum extent permitted by law.

10. Intellectual Property

10.1 Ownership

• The App and all content, features, functionality, code, and design are owned by FixKit and protected by copyright, trademark, and other intellectual property laws
• All trademarks, logos, service marks, and trade names are proprietary to FixKit
• You do not acquire any ownership rights by downloading or using the App

10.3 User Content

• Images captured using the Magnifier tool belong to you
• We do not claim ownership of any photos or content you create using the App
• You are responsible for ensuring you have the right to capture and save any images

11. Third-Party Services and Links

11.1 Integrated Services

The App integrates the following third-party services:

• Google Mobile Ads (AdMob): For displaying advertisements
• Google Play Services: For in-app purchases and app functionality (Android)
• Apple Services: For in-app purchases and app functionality (iOS)
• IP-API.com: For fetching public IP and ISP information in Network Info tool

11.2 Third-Party Terms

These services are governed by their own terms of service and privacy policies:

• Google Privacy Policy
• Google AdMob Terms
• Apple Privacy Policy

11.3 No Endorsement

• We do not endorse or assume responsibility for third-party services
• Your use of third-party services is at your own risk
• We are not liable for any issues arising from third-party services

12. Updates and Modifications

12.1 App Updates

• We may release updates to add features, fix bugs, or improve performance
• Updates may be required to continue using the App
• You are responsible for downloading and installing updates
• We may discontinue support for older versions at any time

12.2 Terms Updates

• We reserve the right to modify these Terms at any time
• Material changes will be notified through:
  • In-app notification
  • Updated "Last Updated" date at the top of this document
  • Email notification (if we have your email)
• Continued use of the App after changes constitutes acceptance of the updated Terms
• If you do not agree to the updated Terms, you must stop using the App

12.3 Feature Changes

• We may add, modify, or remove features at any time
• Pro features may be changed or discontinued
• We will make reasonable efforts to notify users of significant feature changes

13. Termination

13.1 Termination by You

You may terminate your use of the App at any time by:

• Uninstalling the App from your device
• Deleting your app data through device settings
• Ceasing all use of the App

13.2 Termination by Us

We may terminate or suspend your access immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent, illegal, or abusive activities
• Attempt to circumvent technical limitations or security measures
• Misuse the App in any way that harms us or other users

13.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must delete all copies of the App from your devices
• We are not obligated to provide refunds for any purchases
• Provisions that should survive termination (including liability limitations, intellectual property rights, and dispute resolution) will remain in effect

14. Geographic Restrictions and Compliance

14.1 Availability

• The App is intended for worldwide use but may not be available in all countries
• Availability depends on Google Play Store and Apple App Store policies
• Some features may be restricted in certain regions due to legal requirements

14.2 Local Compliance

• You are responsible for compliance with all applicable local laws and regulations
• You must ensure that your use of the App is legal in your jurisdiction
• We make no representation that the App is appropriate or available for use in all locations

14.3 Export Controls

• You agree to comply with all applicable export and import laws
• You may not use or export the App in violation of any applicable laws

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

15.2 Informal Resolution

Before filing a claim, you agree to contact us at etreginwow@gmail.com to attempt to resolve the dispute informally for at least 30 days.

15.3 Arbitration Agreement

Any disputes arising from these Terms or the App shall be resolved through binding arbitration, except where prohibited by law. You agree to:

• Resolve disputes individually, not as part of a class action
• Waive your right to a jury trial
• Waive your right to participate in class actions or class arbitrations

15.4 Exceptions

The following disputes are not subject to arbitration:

• Small claims court actions
• Intellectual property disputes
• Injunctive or equitable relief

16. Miscellaneous Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FixKit regarding the App and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

• You may not assign or transfer these Terms or your rights under them
• We may assign our rights and obligations without restriction
• Any attempted assignment by you is void

16.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network infrastructure failures, or strikes.

16.6 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.

16.7 Survival

Provisions that by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

BY DOWNLOADING, INSTALLING, OR USING FIXKIT, YOU ACKNOWLEDGE THAT:

• You have the legal capacity to enter into this agreement
• You understand that the App provides approximate measurements only
• You will not rely on the App for critical or professional applications
• You consent to the collection and use of data as described in our Privacy Policy
